Brevard County's building department processes thousands of permit applications annually. For custom home construction, the path from application to permit issuance involves multiple review cycles, third-party inspections, and county-specific requirements that can surprise builders unfamiliar with the local process.

The Brevard County Permit Application Process

New home construction in Brevard County requires a building permit from the Brevard County Building and Development department (or the applicable municipal department for homes within Melbourne, Palm Bay, Titusville, or Cocoa Beach city limits). The application package for a custom home typically includes architectural and structural drawings stamped by a Florida-licensed engineer or architect, a survey with lot dimensions and setbacks, energy calculations per Florida Energy Code (ResCheck or equivalent), product approvals for all exterior openings, and a soils report if the lot is in a flood zone or has variable soil conditions.

Brevard's plan review cycle for new custom homes runs 4–8 weeks for the initial review, with comment responses and re-reviews adding additional time. Total permit issuance typically takes 3–5 months from initial submission for a well-prepared package.

Coastal Setbacks and CCCL Restrictions

Properties within Brevard County near the Atlantic Ocean face additional state-level restrictions under the Coastal Construction Control Line (CCCL), administered by the Florida Department of Environmental Protection (FDEP). Any construction seaward of the CCCL requires a separate FDEP permit in addition to the county building permit — a process that can add 6–12 months to a project timeline.

The CCCL is surveyed and periodically updated, so the current line position must be verified on every oceanfront parcel before design begins. In our experience, understanding CCCL restrictions before falling in love with a lot can save significant time and money. We always perform a preliminary CCCL analysis as part of our pre-design due diligence on barrier island and beachfront lots.

Flood Zone Considerations: AE, VE, and X Zones

A significant portion of Brevard County's desirable real estate falls within FEMA-designated flood zones, which trigger additional requirements under both the National Flood Insurance Program (NFIP) and the Florida Building Code. AE zones (base flood, no wave action) require finished floor elevations at or above the Base Flood Elevation (BFE) shown on the Flood Insurance Rate Map (FIRM). VE zones (coastal high-hazard areas with wave action) carry significantly more stringent requirements including open foundation systems and breakaway walls.

We design every home with flood zone compliance as a primary consideration — not an afterthought. For AE zone lots, we typically recommend exceeding the BFE by 2–3 feet (freeboard) to minimize flood insurance premiums and provide long-term protection as sea level changes. The cost of additional stem wall height during construction is a fraction of the flood insurance savings over a 30-year mortgage.

Inspection Milestones and Final CO

Brevard County requires multiple inspection hold points during construction, including foundation/footings before pour, rough framing and sheathing, rough mechanical/electrical/plumbing, insulation, and a final inspection for Certificate of Occupancy (CO). Third-party threshold inspection is required for homes in high-wind zones (which includes most of coastal Brevard).

As your builder, we coordinate all inspections and maintain a running inspection log accessible to you throughout the project. Failed inspections — which add weeks to a project timeline — are rare when the construction team knows the local requirements and builds to them consistently.
